While a large part of the advocacy work the HBA of Michigan does is at the Capitol in Lansing, the fight for attainable housing doesn't stop there. Your state association is engaged in legal battles across Michigan in an effort to fight against unlawful government action and overreach.

The HBA of Michigan has set a goal to raise $1 million over the next two years for legal action. Every dollar helps fuel the legal advocacy needed to stop excessive fees, unlawful regulations and other barriers to housing attainability. Major Victory in Troy Permit Fee Lawsuit

HBAM has secured a significant legal victory in its long-running lawsuit against the City of Troy over excessive building permit fees. After 15 years of litigation, the courts ruled in HBAM’s favor, finding that the City of Troy charged permit fees that exceeded the actual cost of operating its building department. This practice violates Michigan’s Headlee Amendment, which prohibits local governments from generating revenue beyond the cost of providing a service. As a result of the court’s decision, the City of Troy has paid HBAM $575,000 in legal costs.

What This Means for Builders

This ruling sets an important precedent for communities across Michigan. Local governments are required to structure permit fees based on the actual cost of running their building departments, not as a revenue-generating tool.

With this decision in hand, HBAM is actively working with members to identify other communities that may be charging unlawful permit fees.
