Our History

As the voice of Michigan's residential construction industry, the HBA of Michigan has spent the last 75 years advocating for policies that protect and promote housing attainability. To honor this milestone, we asked some of our past presidents to reflect on the advocacy efforts they led during their time as state president. These efforts have helped shape the landscape of Michigan's housing industry, often through hard-fought battles that have ultimately benefited our members and communities. 1995 - Repealed the Model Energy Code

Repealed the Model Energy Code (MEC) which added between $2,300 and $4,800 to the price of a newly built home and assisted in writing the Michigan Uniformed Energy Code

1999 - Assisted in writing the Uniform Energy Code

Lobbied to pass the Single State Construction Code bill, replacing the MEC and creating a uniform code for the entire state. This provided an additional savings of $2,523 per home.

2002 - Modified architects seal requirements

Modified architects seal requirements by redefining what counts as ‘habitable space’ for the requirement of a seal at 3,500 sq ft, saving an average $2,500 per home.

2007 - Michigan Consumer Protection Act

Defeated attempts to remove the builder exemption from the Michigan Consumer Protection Act - an exemption we are fighting for again in 2024.

2008 - Helped protect private property rights

Helped protect private property rights by negotiating the language of the 2006 constitutional amendment prohibiting the use of eminent domain for either economic development or the enhancement of tax revenues and curtailing the ability of local units of government to abuse “blight” designations.

2010 - Sold the HBAM office building

Sold the HBAM office building and moved to a new one, saving enough money to weather the housing crash.

2011 - Helped repeal the Michigan Business Tax

Helped repeal the Michigan Business Tax, ending the double taxation of 95,000 small business and replaced it with a 4.35% corporate business tax, paid through income tax, for S-Corps, LLCs, LPPs, etc., while C-Corps pay a straight 6% corporate income tax.

2011 - Filed the Troy Lawsuit

Filed the Permit Fee Overcharge Case against the City of Troy. The court’s 2023 ruling upheld our position and said Troy violated the Headlee Amendment, but that HBAM doesn’t have the standing to be awarded its legal fees. We are currently waiting on the results of the appeal and ultimately expect to get our legal fees back.

2012 - Eliminated the 18-mil inventory tax

Eliminated the 18-mil inventory tax on new homes and the land they sit on.

2012 - Flex code legislation

Helped pass flex code legislation giving the State the option to update codes every 6 years, reducing code book purchases and training expenses. 

2012 - Reformed the Critical Dunes Act

Reformed the Critical Dunes Act to balance development needs with environmental protection, freeing up nearly 25,000 acres of coastline property for development.

2013 - Wetland Regulation

Supported legislation that enabled Michigan to oversee the regulation of its wetlands instead of the federal government. MI was initially one of only two states authorized to do so.

2013 - Negotiated a new energy code

Negotiated a new energy code that complies with Michigan's cost-effective requirements while providing up to a 25% increase in energy efficiency in new homes over what was the current code at the time.

2015 - Local Government Regulatory Limitation

Supported legislation that would enact the Local Government Labor Regulatory Limitation Act to prohibit local governmental bodies from adopting or enforcing an ordinance, policy or resolution that imposes certain requirements or regulations on an employer.

2015 - Skilled to Build Michigan Foundation

Creating Skilled to Build Michigan Foundation to raise awareness of the skilled trades as a viable career option by cultivating, educating and recruiting students and veterans into the residential construction trades.

fixed affiliation fees

Switched to a fixed affiliation system, replacing the member dues system with a flat rate for each local.

2017 - Authored a Call-to-Action Report

Authored “Housing Challenges Economic Pressure: Where will 10,000,000 Michiganders Live?” which made recommendations for local government and economic development leaders on how to revamp their land development and inspection and permitting systems to encourage housing development. This led to a historic shift in focus on our State’s workforce housing shortages.

2020 - Switched our governance structure

Switched our governance structure to a smaller board of directors as opposed to hundreds of members.

2021 - YP Pilot Program

Encouraged NAHB to adopt a young professional recruitment program and offer a promotional dues rate for members 45 and younger.

2022 - Housing Michigan Coalition Bill Package

The Housing Michigan Coalition helped pass four new workforce development tools into law. These four bills allow builders, developers and non-profits to work with their local municipalities to create property tax relief on projects aimed at providing workforce housing for those who fall within 80-120% of the area median income.

2023 - Brownfield Redevelopment Financing Act

Supported the Brownfield Redevelopment Financing Act which amended the 1996 Public Act 381 and gave MSHDA new review, oversight and funding roles, including Tax Increment Financing for housing.
